Financial Exploitation Case
Negotiated favorable settlement of financial exploitation of an elderly person and trust contest against three (3) caregivers where “death bed” trust amendment provided over one million dollars ($1,000,000.00) in bequests of automobiles, a condo and cash to caregivers and resulted in caregivers agreeing to return assets to family members in accordance with the deceased prior estate plan which did not include caregivers
Will Contest Case
Negotiated favorable settlement of will contest and trust contest where deceased had been declared totally incapable of making large scale financial decisions shortly before allegedly executing will and trust amendments disinheriting one sister and provided other sister with estate worth over three million dollars ($3,000,000.00)
Trust Contest Case
Negotiated favorable settlement of will contest and trust contest where will and trust amendments provided caregiver with ownership interest in Wilmette house worth over six hundred thousand dollars ($600,000.00) and other valuable assets and resulted in caregiver returning assets so they could be distributed in accordance with the decedent’s unaltered estate plan
Human Rights Case
Negotiated favorable settlement of housing discrimination and civil rights violation lawsuit under the Illinois Human Rights Act against landlord for refusing to rent to an African American family of five based on their race
Guardianship Case
Negotiated favorable settlement of contested guardianship of elderly person where son was attempting to gain control over elderly person’s estate
Business Litigation Case
Negotiated favorable settlement of citation to recover two CDs worth over seven hundred thousand dollars ($700,000.00) from accountant and paramour of decedent
Kennedy v. Garfoot Trucking, Inc.
(2013 IL App (1st) 1112077-U): Authored appellee brief which affirmed $2,725,000.00 jury verdict for wrongful death where no trial errors were found
Danhauer v. Danhauer
(2013 IL App (1st) 123537): Authored appellant briefs which reversed circuit court’s grant of summary judgment where issue of material fact was found to preclude summary judgment based on mutual mistake
State ex rel. Pusateri v. Peoples Gas Light and Coke Co.
(2013 IL App (1st) 120972-U, 2014 IL 116844): Authored appellee brief which reversed the circuit court’s 2-615 dismissal of claim under the False Claims Act. The appellate court was reversed by the Illinois Supreme Court which found that plaintiff’s remedy did not evoke the circuit court’s subject matter jurisdiction.
